1. Acknowledgement of Risks
I, the undersigned, understand that participating in activities at Splatter Art Creations Inc. involves inherent risks. These activities include, but are not limited to, the use of paint, paint splattering, spraying, dripping, and other forms of art creation. I acknowledge that these activities may result in paint coming in contact with my clothing, skin, or personal belongings, which could cause damage or stains. Although Splatter Art Creations Inc. will provide protective gear, I understand that it may not fully prevent paint from contacting me or my belongings.
2. Assumption of Risk
I voluntarily choose to participate in the activities offered by Splatter Art Creations Inc., fully aware of the risks involved. I understand that the environment may be slippery, and I must exercise caution to avoid injury. I assume all risks, known and unknown, associated with these activities, including, but not limited to, the risk of physical injury, property damage, or any other type of harm or loss.
3. Release of Liability
In consideration of being allowed to participate in the activities at Splatter Art Creations Inc., I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and hold harmless Splatter Art Creations Inc., its owners, employees, agents, and representatives (the "Releasees") from any and all claims, demands, actions, or causes of action, including but not limited to those for negligence, gross negligence, willful misconduct, or any other liability. This includes any injury, loss, or damage arising out of or related to my participation in activities at Splatter Art Creations Inc., including personal injury, death, or property damage, whether caused by the negligence or willful misconduct of the Releasees or otherwise.
4. Indemnification
I agree to indemnify and hold harmless Splatter Art Creations Inc., its owners, employees, agents, and representatives from any and all liabilities, claims, damages, or costs, including legal fees and expenses, arising from my participation in the activities, whether caused by my actions or otherwise.
5. Safety Rules
I understand and agree to abide by the following safety rules while participating in activities at Splatter Art Creations Inc.:
No running, pushing, shoving, or throwing containers or paint at other participants.
Keep your hands to yourself and respect other participants' space.
No food is permitted unless previously arranged.
Children must be always supervised by a responsible adult.
No standing on chairs or tables.
Do not pull-down plastic wall coverings or tamper with the setup.
Outside paint supplies are prohibited.
Leftover paint must be disposed of properly in the designated area.
I understand that failure to comply with these safety rules may result in immediate suspension of participation privileges without a refund.
6. Media Release
I grant permission to Splatter Art Creations Inc. to take photographs, videos, or other media recordings of me during the activities. I understand that these recordings may be used for promotional, marketing, or advertising purposes in any media format. I waive any rights to compensation or ownership of such media and any rights to review or approve its use.
7. Health and Safety
I certify that I am in good health and have no medical or physical conditions that would prevent me from safely participating in the activities at Splatter Art Creations Inc. I agree to follow all safety instructions provided by the staff and to immediately report any injuries or unsafe conditions.
8. Governing Law
This waiver and release of liability shall be governed by and construed in accordance with the laws of New Brunswick, Canada. Any disputes arising from this agreement shall be resolved exclusively in the courts of New Brunswick.
9. Final Legal Clause
By signing this document, I acknowledge that I have read, understood, and accepted the terms and conditions outlined above. I further agree that this waiver may operate as a complete defense to any claims or lawsuits related to my participation in activities at Splatter Art Creations Inc. I confirm that I am not under the influence of any substances, including alcohol or drugs, that may impair my judgment or motor skills. This document represents the entire agreement between the parties and supersedes any prior statements or representations. Any breaches of these terms may be enforced through legal action.
Minor Participants
If the participant is under the age of 18, a parent or legal guardian must sign this waiver on their behalf. By signing below, the parent or guardian acknowledges and agrees to the terms and conditions of this waiver and assumes responsibility for the minor's participation. The parent or guardian also agrees to enforce the safety rules for the minor.
